Owner and managing attorney of The Law Offices of Melissa A. Day, PLLC, in Amherst, exclusively practices workers’ compensation defense. Melissa began her practice defending workers’ compensation insurance carriers and self-insured employers since shortly after she was admitted in 1997.

Melissa has extensive appellate experience and has briefed well over 50 cases at various appellate divisions including successfully arguing Burns v. Varialle, 9 N.Y.3d 207, 879 N.E.2d 140, 849 N.Y.S.2d 1.

In addition to amassing over 20 years of general workers’ compensation defense experience, Melissa is extremely well versed in workers’ compensation subrogation issues and general liability defense; she has appeared in numerous courts across New York on motions and orders to show cause frequently in connection with third-party claims for judicial approval nunc pro tunc and for apportionment of attorneys’ fees.

Melissa frequently lectures on and blogs about recent developments in workers’ compensation law. She is the founder, owner and moderator of the Linkedin Group New York Workers’ Compensation Forum, which currently boasts over 1,800 members.

Melissa’s degrees are from Canisius College where she received a B.A. in English and from Notre Dame Law School where she earned her J.D. Melissa grew up in Lake View, New York, and she and her husband, now live in Amherst, New York, with their son, their dogs, Mush and Bear, and their LOMAD rescue cats Poof, Herbie and Sweet Pea.
